By downloading, installing, or using NeuralCalm (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years old to use NeuralCalm. If you are between 13 and 18 years old, you represent that you have your parent's or guardian's permission to use the App.

3. Nature of the Service

NeuralCalm provides:

• Breathing exercises and grounding techniques
• Mood tracking and journaling tools
• Educational content about anxiety management
• AI-assisted support through Luna (our AI companion)
• Crisis resource information and quick access to helplines

NeuralCalm is a wellness app, not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease or mental health condition.

4. Not Medical Advice

Always consult with a qualified healthcare provider regarding any questions about a medical condition or mental health concern.

5. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

6. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Reverse engineer or attempt to extract the source code
• Use the App to harm, harass, or abuse others
• Misrepresent your identity or affiliation

7. Privacy

Your use of NeuralCalm is also governed by our Privacy Policy. We are committed to protecting your mental health data and only use anonymized, aggregate data to improve our services.

8. Subscriptions and Payments

NeuralCalm offers free and premium subscription tiers. If you purchase a premium subscription:

• Payments are processed through Apple App Store or Google Play
• Subscriptions automatically renew unless cancelled
• You can cancel anytime through your device's subscription settings
• Refunds are handled according to Apple/Google's policies

9. Intellectual Property

All content in NeuralCalm, including text, graphics, logos, and software, is owned by NeuralCalm or its licensors and is protected by copyright and other intellectual property laws.

10. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEURALCALM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless NeuralCalm and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

13. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. You may stop using the App at any time.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
